
Employers are legally required to manage health and safety.
Certain health and safety responsibilities can be delegated but accountability remains with the employer.
When something goes wrong employers face the possibility of prosecution. In an investigation the questions asked would include; ‘has the employer carried out suitable and sufficient risk assessments, designed safe systems of work, provided suitable training, instruction and supervision?’
Employees also have legal duties under health and safety law and employers must make sure that employees are aware of them.
Training is essential. Rather than ask ‘can I afford to train myself and my staff?’, it may be sensible to ask, ‘can I afford not to?’
Neglecting to fulfil legal duties may result in fines, imprisonment and the payment of compensation should there be a civil case.
There is also a moral duty to manage health and safety effectively. Training is vital in contributing towards a good health and safety culture where management and employees feel they have a crucial role to play in creating and maintaining sound health and safety standards, reducing workplace accidents and ill health.
